The following steps are required for a personal representative to have a will admitted to probate:
- Present the original will to the clerk of circuit court's office for proof (if there is not a self-proving clause in the will), either by the testimony or deposition of one of the subscribing witnesses or by 2 disinterested persons who can verify the handwriting and signature on a holographic (handwritten) will.
- Arrange for surety (security) on the bond unless it is waived by law or in the will.
- Furnish a List of Heirs at Law.
- While not absolutely necessary, you should call the Clerk's office for an appointment. For the Office of the Clerk of Circuit Court for the city of Roanoke, call 540-853-5832 or 540-853-6712.
Probate fees are based on the value of the estate and may be paid with cash, check or a Visa or MasterCard credit/debit card. Effective July 1, 2012, the following service fees apply if using a Visa or MasterCard credit/debit card. The service fee for charges $50 and under will be $2.
