About the Board

Ordinance 39438-070212 changed the name of the Building Code Board of Appeals and created the Building and Fire Code Board of Appeals. Pursuant to the building code, there is hereby created a Building and Fire Code Board of Appeals, which shall consist of 9 members, who shall be appointed by City Council. The Building and Fire Code Board of Appeals shall have jurisdiction to consider appeals pursuant to the building code, as the same is amended from time to time by the state Board of Housing and Community Development.

Virginia Construction Code, part I of the Virginia Uniform Statewide Building Code, 2009, Section 119, Appeals, 119.1 Establishment of appeals board, states that “In accordance with Section 36-105 of the Code of the Virginia, there shall be established within each local building department a Building and Fire Code Board of Appeals.” An affected party may appeal the decision of the local Code Official to the Building and Fire Code Board of Appeals, and the Building and Fire Code Board of Appeals shall have the power to uphold, reverse, or modify the decision of the official.

A completed application form with a detailed description of the appeal and a file fee of $75 is accepted in the Permit Center. All appeals are scheduled for hearing by the Secretary to the Board within 30 days of receipt of application.
