Weeds and Trash Abatement Program

General Information about Code Enforcement

Roanoke's weed and trash ordinance (Chapter 33, Article II, of the Code of the City of Roanoke) prohibits vegetation over 10 inches high (not including shrubs and trees) and accumulation of trash and debris on a property.

Using the process below, the city will notify the property owner of a violation. If the owner does not abate the violation, the city will have the property cleaned up and send the owner a bill for the cost of abatement, plus an administrative fee of $100. Repeat violators will only receive one notice from the city to abate additional violations during the growing period of April 1 to November 1.

THE PROCESS
  • The city receives a referral or complaint from an individual about weeds and/or trash on a property.
  • City staff inspects the property to determine if there is a violation.
  • If there is a violation, the property is posted with a Notice of Violation.
  • The owner of record is also mailed a copy of the Notice of Violation giving 7 days to abate the nuisance.
  • City staff re-inspects the property.
  • If necessary, the property owner is summoned to court.
  • An inspector photographs the violation and notifies the city's contractor to abate the nuisance. The contractor has 5 days to cut the vegetation and/or remove the trash.
  • City staff re-inspects the property to verify that the violation has been abated.
  • If the violation has been abated, the property owner is billed for the work and the case is closed. The bill will include the cost of the abatement (with a minimum of two hours labor billed) and an administrative fee of $100.
  • If the owner does not pay the bill, a lien will be placed on the property.
    Note that it may take several weeks for the process to play out before the violation is actually abated. During this time, the city is actively pursuing abatement of the violation, and we appreciate your patience.
