Procedure to Rezone Property
1. Prior to filing any rezoning application, the applicant shall meet with the staff of the Office of Planning, Building and Development to determine that all filing requirements have been met and that all information contained in the application is correct. For more information, click on this link: Rezoning & Street/Alley Closure Applications The Office of Planning, Building and Development shall determine the required fees. A statement determining compliance with the Zoning Ordinance will be prepared by the Secretary or Agent to the City Planning Commission and attached to the application to rezone prior to the filing of any application. The applicant is responsible for any and all advertising costs incurred for advertisement of applications for public hearings before the City Planning Commission and City Council and will be billed by the City or the local newspapers for such costs.
2. Upon completion of the City Planning Commission's public hearing, a report from the Planning Commission to City Council will be forwarded to the City Clerk who will schedule the date for a public hearing before City Council. Public hearings before City Council are held on the third Monday of each month at 7:00 p.m., or as soon thereafter as the matter may be heard.
The requested rezoning will be advertised for public hearing before City Council for two consecutive weeks. The City Attorney's Office will prepare the advertisement and an appropriate ordinance providing for the rezoning. The applicant will be provided with a copy of the ordinance for review prior to the public hearing before City Council.
If City Council concurs in the request for rezoning, the Ordinance rezoning the property will be adopted on the evening of the public hearing and will become effective upon its adoption.
